• There is a
minimum subscription period of 12 months for Link3 FTTX Services (or such
other period as may be specified by Link3).
• Service Activation of BDT 5000 has to be paid upon registration.
• Link3 Technologies Ltd. will retain Ownership and rights to all the
Optical Network Equipment provided to CLIENT at all times. If any of the
parties (CLIENT or Link3 Technologies Ltd) terminates the service then Link3
Technologies Ltd. will bring back their Equipment.
• Customer has to provide necessary information with regard to application
and incomplete form will result in application being rejected or delay.
• Use of Link3 FTTX Services is subject to its most current Acceptable Usage
Policies.
• The customer acknowledges that:
• Continuity and connection speed of Internet access depends on a wide range
of factors, many of which are beyond the control of Link3.
• Link3 has no control over the accuracy or appropriateness of any
information on the Internet.
• Link3 is not responsible for any software available on the Internet.
• The customer's Internet access may be interrupted by a variety of factors,
including, but not limited to, equipment failure, the need for routine
maintenance and peak demand. At all times Link3, will in its best endeavours,
keep Internet access available continuously.
• Link3 will make its Broadband Connect service available at least 95% of
the time, averaged over a quarterly period.
• Link3 shall not be held liable for any losses whatsoever that may be
incurred by the customer as a result of the customer's inability to gain
access to the Internet. The customer indemnifies Link3 against any
liability, claim, action, suit, demand, loss, cost or expense whatsoever
arising out of or in any way connected with this agreement or Internet
access, including any negligence by Link3 or their resellers.
• The customer must not deliberately or carelessly do anything that damages
Link3 equipment, software, set-up or services.
• The sending of bulk e-mail (spamming) is strictly forbidden and the
customer's account is immediately terminated.
• Link3 may terminate the customer's Internet access immediately if the
customer breaches this agreement or the rules, or fails to promptly pay any
money owed to Link3.
• The customer agrees to receive e-mail from Link3 on Promotional
Information and Network Issues.
• All amendments to the Terms and Conditions are effective to all customers
within seven days, while all amendments to the plans and pricing provided
will be effective to all customers within 30 working days.
• Connection of service will occur within maximum 7 days after Link3 has
received a signed contract from the customer. Link3 will endeavor to restore
Services within 24 hours where a system fault occurs during a weekday and 48
hours where a System fault occurs during a weekend.
• All fees and charges are payable within the Due Date printed in the bill.
• Link3 expressly disclaims all warranties or representations of any kind,
whether express or implied, including warranties of merchantability,
satisfactory quality, fitness for a particular purpose and non-infringement
to the fullest extent allowed by law.
• It is the User's responsibility to
(a) ensure that his computer and other hardware meet the Service's
minimum system and operating system compatibility requirements, as the same
may be prescribed by Link3 from time to time, and
(b) ensure that his system is free of viruses and any malware. Link3
shall not be liable for any Service failure resulting from the User's
non-compliance with such requirements, or any configuration or installation
changes not expressly authorized by Link3. Link3 reserves the right to
temporarily discontinue its service if any virus from the client's network
affects Link3 network or its upstream providers or any other network that
may be accessed by the virus using Link3 network, until the problem is
completely cured.
• Link3 reserves the right to amend the FTTX Terms and Conditions
(including, without limitation, the charges and fees herein stated) at any
time from time to time and such amended terms and conditions shall be
binding on the User upon such amendment coming into effect in accordance
with the provisions of the General Terms and Conditions.
• If there is any damage to the equipment due to misuse or negligence of the
client (if the equipment is burnt or damaged by power problem, mishandling,
fire, lightning, or any natural disaster, theft or sabotage, water submerge,
come in contact with water, drop from height and damaged partly or fully)
then the client will pay the amount necessary to replace the equipment.
